O desembargador
Diogo Pítsica, em decisão publicada às 22h10 desta sexta-feira, 5, não concedeu
o pedido de liminar através de um mandado de segurança impetrado pela
Procuradoria-Geral do Estado, para derrubar a decisão que impede o governador
Jorginho Mello (PL) de nomear o seu filho, Filipe Mello, como chefe da Casa
Civil. O magistrado entendeu que a questão não é para ser decidida no plantão,
mas sim, o relator é quem deve decidir na próxima segunda-feira quando encerra
o recesso do judiciário.
Na decisão, Pítsica
reconheceu a tese apresentada pela Procuradoria Geral do Estado (PGE),
inclusive, citando que “o Supremo Tribunal Federal (STF) já promoveu amplo
exame da questão do nepotismo, tendo assegurado a alocação de secretários, a
exemplo do Chefe de Casa Civil, como integrante do quadro político, não
caracterizando o nepotismo.
Segundo o
desembargador, o advogado Filipe Mello, que já ocupou o cargo de secretário de
Estado e também municipal, detém todas as qualificações e predicados à função,
sendo que enumerou os cargos ocupados.
Ainda no texto, o
desembargador destaca que a interpretação mais plausível é a de que a Súmula
Vinculante número 13 do STF não é extensível a cargos políticos. “Rememoro os
dizeres de que o Supremo Tribunal Federal tem afastado a aplicação do referido
verbete a cargos públicos de natureza política, conceito no qual se incluem os
secretários municipais ou estaduais”.
